1. Agreement to Terms
These Terms of Service constitute a legally binding agreement made between you and Carelysis Health Tech ("Company," "we," "us," or "our"). By accessing the Carelysis mobile application (the "App") or our website, you agree that you have read, understood, and agree to be bound by all of these Terms of Service.
2. Medical Disclaimer (NOT MEDICAL ADVICE)
THE APP DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.
All content provided through Carelysis, including AI-generated nutrition scores, food analysis, and health insights, is for informational and general wellness purposes only. It is not intended to be a substitute for professional medical advice from a licensed healthcare provider.
Always seek the advice of your physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read on this App.
3. AI & General Wellness Policy
Carelysis is a General Wellness Product as defined by the FDA. It is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease.
- AI Inaccuracies: The App uses Google Gemini AI for food analysis. AI-generated outputs may contain errors, omissions, or inaccuracies. You should independently verify any nutritional information provided.
- Non-Human Interaction: In accordance with California AB 489, you are hereby notified that the nutritional analysis and "conversational" insights are generated by Artificial Intelligence and not by a natural person or licensed professional.
- Automated Decision-Making: We use automated systems to provide scores. While these affect your App experience, they do not constitute "legal or similarly significant decisions" as defined under GDPR/CCPA.
4. Eligibility & User Representations
By using the App, you represent and warrant that:
- You are at least 13 years of age.
- All registration information you submit is true and accurate.
- You will use the App in compliance with all applicable laws and regulations.
5. Intellectual Property Rights
Unless otherwise indicated, the App, its source code, databases, algorithms, and AI-integrations are our proprietary property. Your food photos remain your property, but you grant us a license to process them to provide the service.
6. Prohibited Activities
You may not:
- Use the App for any illegal or unauthorized purpose.
- Attempt to reverse engineer or scrape the AI models or data.
- Submit false or misleading information to "game" the nutrition scores.
- Use the App for clinical or diagnostic purposes.
7. Account Termination & Deletion
Termination by You: You may terminate your account at any time by using the "Delete Account" feature within the App settings or by contacting us. Upon termination, your right to use the App will immediately cease.
Termination by Us: We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
Effect of Deletion: Upon account deletion, all personal data, health logs, and food photos associated with your account will be permanently removed from our active systems. Some anonymized data may remain in our backups for a limited period or be retained if required by law.
8. Limitation of Liability
To the fullest extent permitted by law, Carelysis Health Tech shall not be liable for any indirect, incidental, or consequential damages arising out of your use of the App, including reliance on AI-generated nutritional scores.
8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California and the United States, without regard to its conflict of law provisions.
